CastMeNow was built in collaboration with artists, for artists. We believe every actor should have access to powerful tools—not just agencies and casting companies. These Terms are here to protect your rights, our ability to support you, and the shared space we've created.

We're on your side. Always.

1. Acceptance of Terms

By accessing or using CastMeNow ("we," "us," "our," or "the Platform"), you ("you," "your," "User") agree to be legally bound by these Terms of Service ("Terms").

By continuing, you confirm that:

• You are at least 18 years old, or have received verifiable parental or guardian consent if under 18
• You understand and accept these Terms in full
• You authorize CastMeNow to act as your representative for identifying and submitting you to casting opportunities

If you do not agree, do not use the platform.

2. Representation Authorization

By using CastMeNow, you appoint us as your limited submission representative. This includes:

• Accessing your casting materials and profile info
• Submitting you to appropriate projects and roles
• Reviewing publicly available casting opportunities and matching them to your preferences
• Performing actions you would otherwise perform manually

This is a revocable, non-exclusive, opt-in relationship. We are not your legal agent, union rep, or employment manager.

3. Third-Party Platform Relationships

CastMeNow is not affiliated with, endorsed by, or officially partnered with any casting website, agency, or union.

You agree that:

• Your use of any third-party casting platform is at your own discretion
• You provide access voluntarily for us to act on your behalf
• You remain responsible for complying with those platforms' terms
• You are the official account holder—we act only under your instruction

Important Clarification Regarding Third-Party Terms of Service:

CastMeNow does not guarantee or commit to compliance with any terms of service, policy updates, restrictions, or rules introduced or modified by third-party casting platforms after December 31, 2024.

By using CastMeNow, you acknowledge and agree that:

• Our actions are performed under your direction and access, using credentials you voluntarily provide
• We are not liable for any enforcement, ban, penalty, or dispute resulting from retroactive rule changes or new platform-specific restrictions introduced after December 31, 2024
• Any conflict regarding those changes is between you and the third-party platform, and outside the scope of our responsibility

CastMeNow is a user-authorized service. We do not bypass access controls or interfere with external systems, and we operate strictly within the permissions you grant us.

4. Account Responsibility

You're responsible for:

• Keeping your CastMeNow and external account credentials secure
• Ensuring your profile info is accurate and up to date
• Reviewing and verifying all submissions made through the platform

We act only under your consent, using your access. Any disputes with external platforms are between you and them.

5. Subscription Terms

• You may explore CastMeNow via a free trial, if one is offered
• Subscriptions begin only when you activate a paid plan
• Billing cycles (monthly or annual) start upon plan activation
• You can cancel, upgrade, or downgrade at any time via your dashboard
• Refunds are only issued if required by law or stated in our refund policy
• Pricing or features may change with notice via email or in-app

6. Data Use & Storage

By using CastMeNow, you authorize us to securely collect and manage:

• Your uploaded media (headshots, resumes, reels)
• Submission history, preferences, and platform activity
• Role info and casting data made accessible to you

We maintain a private database of casting opportunities sourced from:

• Publicly available or semi-public listings
• Third-party feeds or trusted partners
• Opportunities accessed by users or shared within our platform

You agree that:

• We may use this information to enhance your experience
• Any data accessed by you (or by us on your behalf) may be indexed internally
• If you can access it, we can process it on your behalf

We do not currently sell personal data. In the event of an acquisition or merger:

• We may transfer relevant platform data to support continued artist services
• Such transfer will comply with data protection laws (e.g., CCPA, GDPR)

These Terms double as our Privacy Policy. There are no hidden documents, fine print, or footnote tricks.

7. Intellectual Property

All technology, systems, designs, and features built by CastMeNow are our sole intellectual property.

You may not:

• Reverse-engineer or create derivative services
• Interfere with system functionality
• Use bots, scrapers, or automated monitoring tools on our platform

You retain full ownership of everything you upload. You grant us a limited license to use your content only to deliver platform services to you.

We do not sell, repurpose, or use your materials for AI model training or unrelated commercial activity.

8. No Guarantee of Results

We increase your efficiency and visibility. We do not and cannot guarantee:

• Auditions
• Jobs
• Representation
• Any specific result

We are a toolkit. Final casting decisions are up to the people behind the tables.

9. Total Liability Waiver & Indemnification

You agree that:

• You use CastMeNow at your own discretion and risk.
• You are solely responsible for all activity, submissions, and outcomes tied to your use of the platform.

You agree to fully indemnify and hold harmless CastMeNow, its owners, contractors, and affiliates from any claim, liability, loss, damage, or legal dispute—including but not limited to:

• Your submitted content or data
• Platform bans or TOS violations from other services
• Misrepresentation, access disputes, or eligibility issues
• Any third-party claim based on your use of the service

We do not act as your employer, fiduciary, legal representative, or manager. We operate only under your instruction and access.

10. Copyright & Content Compliance

We do not host or distribute restricted casting calls, paywalled breakdowns, or proprietary content from third-party platforms.

All listings we index are:

• Public
• Semi-public
• Accessed via user-authorized accounts

We don't republish or redistribute breakdowns. Matching happens within your private dashboard. If you believe something shouldn't appear, you may notify us informally.

11. Suspension & Termination

We may suspend or terminate access to CastMeNow at any time, including (but not limited to) for:

• Abuse, disruption, or rule violations
• Attempts to hack, replicate, or harm the platform
• Violations of these Terms

We are not required to respond to third-party takedown requests unless compelled by binding U.S. law.

12. Entire Agreement

This is the entire agreement between you and CastMeNow. No side clauses. No hidden terms.

If any section is found unenforceable, the rest of these Terms still apply.

We do not maintain a legal support inbox. Please do not contact us for legal matters unless required by court or statute.
